Tyson Banned from Marketing ?Antibiotic Free?

A federal appeals court has upheld a previous ruling banning Tyson Foods, Inc. from marketing its chicken products as raised without antibiotics that impact antibiotic resistance in humans. Tyson had appealed the injunction which went into effect May 1.

The injunction does not affect the labeling of Tyson's chicken products, but prevents the company from advertising the program. The original lawsuit was filed by competitors Sanderson Farms, Inc. and Perdue Farms which claim the marketing language is misleading to consumers.
